EatSleep Terms of Use

EatSleep is operated by Pinotech LLC ("Pinotech," "we," "us"), a company organized in California, USA. By downloading or using EatSleep, you agree to these terms. If you don't agree, don't use the app.

Who can use EatSleep

You must be 18 or older. EatSleep asks you to confirm this during setup and is not directed at children.

EatSleep is not medical advice

EatSleep is a wellness tracking tool, not a medical device, and nothing in it is medical advice. Calorie targets, macro breakdowns, sleep scores, exercise estimates, and anything the app says about GLP-1 medications are informational estimates, not diagnosis or treatment. Decisions about your medication — the drug, the dose, the schedule — belong to you and your prescriber. Never start, stop, or change a medication, or disregard professional medical advice, because of something EatSleep showed you.

AI-generated estimates can be wrong. A photo estimate of a meal, an imported recipe's macros, or a calorie-burn figure is a starting point to check and edit, not a measurement. If you have an allergy, an eating disorder, diabetes, or any condition where the numbers really matter, verify them from the product's own label or your clinician's guidance.

Your account

On first use, EatSleep creates an anonymous server account so AI requests can be metered fairly. You can optionally link an email for sign-in and account recovery. Linking an account does not upload or sync your diary. Anyone with access to your unlocked phone has access to your diary, and if you erase the app's data or lose the device, signing in does not restore what was stored locally. Use the in-app export if you want a copy.

Fair use

The AI features (photo estimation, recipe import, corrections) cost us money per request, so they carry daily usage limits. You agree not to:

Your content

Everything you log — meals, photos, weights, sleep, medication records — is yours. You give us only the limited permission needed to run the features you use: for example, sending a meal photo to our AI provider to identify the food. How that data is handled is described in the privacy policy; these terms don't expand it.

When you import a recipe from a link, a photo, or pasted text, you're responsible for having the right to use that content for your personal logging. EatSleep processes what you hand it; it doesn't grant you rights to anyone else's recipes or videos.

Third-party content

Nutrition data comes from sources like USDA FoodData Central and Open Food Facts, and barcode lookups return what those public databases contain. Recipe links go to sites and platforms we don't control. We're not responsible for the accuracy of third-party data or the availability of third-party sites.

Subscriptions

If EatSleep offers a paid subscription, billing runs through Apple or Google: prices are shown before you buy, the subscription renews until you cancel in your app-store account settings, and refunds follow the app store's own policies. We'll surface any price change in the app before it applies to you.

Our stuff

The app, its design, and its code belong to Pinotech and its licensors. These terms give you a personal, non-transferable license to use EatSleep on your own devices, and nothing more.

Disclaimers and limits on liability

EatSleep is provided "as is," without warranties of any kind, express or implied — including fitness for a particular purpose and uninterrupted or error-free operation. To the fullest extent the law allows, Pinotech's total liability for any claim arising out of EatSleep is limited to the greater of $50 or what you paid us in the twelve months before the claim, and we are not liable for indirect, incidental, or consequential damages, or for lost data. Some jurisdictions don't allow some of these limits, so parts may not apply to you.

Ending things

You can stop using EatSleep at any time; Settings → Data & privacy → Erase all data removes your local records and your anonymous account. We may suspend or terminate service for accounts that violate these terms. Sections that by their nature should survive (your content, disclaimers, liability limits, governing law) survive termination.

Changes to these terms

If we change these terms, we'll update this page and the effective date above. Material changes will be surfaced in the app before they take effect; continuing to use EatSleep after that means you accept them.

Governing law

These terms are governed by the laws of California, USA, without regard to conflict-of-law rules, and any dispute will be resolved in the state or federal courts located in California.
